New Brunswick’s Privacy Legislation
New Brunswick has specific privacy legislation for organizations operating in the public sector, but unlike British Columbia, Alberta, and Quebec, has no specific privacy legislation for organizations operating in the private sector. Instead, the Personal Information Protection and Electronic Documents Act (PIPEDA) applies to the private sector.
The Office of the Ombudsman enforces Protection of Personal Information Act. The ombudsman is Bernard Richard.
Public Sector Legislation
New Brunswick’s public sector privacy legislation is the Protection of Personal Information Act. You may also read the Right to Information Act, which authorizes the Ombudsman to conduct investigations under the Act.
For example, this legislation will apply to the educational and health care bodies in New Brunswick, along with the government departments. For a complete list of government departments, read Schedule A of the regulation.
